Default will the makaratasi go through? - 07-27-2007, 02:12 PM

Hi members,

My fiance is in the process of getting her employment based green card, she already has her work permit and might get the card before the end of year.

Here is my question, if we get married in the next few weeks, her lawyer says he can add me to her application but is not sure whether it will succeed or not. Does anyone know of a similar situation and what were the results? what are your suggestions and or advice?

By the way i have been out of status for about 4 years. I know status does not matter when a citizen files for you but am not sure in this case whether when we get married,my wife can successfully include me in her application.

All suggestions and advice are most welcome.

Get married before the application goes through, and you will be considered a spouse, as long as you have been faithfull in paying taxes, have no felonies or too many misdemenour A and no aids, being out of status is something really small time

Normally, even tho one person lodges the application, the two of you are treated differently. If they find u lacking, they'll deny u, give her. But if ni fines and all that, they will deal with ur case differently and hers differently. Soyou are better off applying whatever happens happens but be sure u dont expose urself for deportation.

Talk to an Attorney. They will usually give you sound legal advice and save you the hussle of getting into trouble with the immig fellas. I seem to remember being told that if you are out of status, only a US citizen can successfully file for you makaratasi. Not an HIB applicant or a Green Card Holder. I could be wrong though.

actually I have seen some guys win green cards while they are still here and applied and had their status changed, and at that time they were miserably out of status,

if he is a spouse, he automatically gets the privildges that accompany the wife
