Did Kibaki order you to go kill? Did Kibaki order you or yours to get killed? Is there evidence on this with ICC?
Similarly, Did Raila order you to go kill? Did Raila order you or yours to get killed? Is there evidence on this with ICC? Otherwise, Kibaki and or Raila walk free to laugh and fight another day! But perhaps Ruto, Kosgey, and Franko will shed some more light while at the Hague on any specific instructions they got from Raila...and Anyang Nyongo (Mkimwa) so that Raila too can be indicted. It appears to be their line of defence that Raila said, or Raila called.... While I dislike PNU since I defected to Narc-Kenya, I do not see any indictments on the PNU side! Sorry for disapointing you my ODM friends by not dropping a few names here.

he will have a tough time explaining Naivasja and the thugs behind it but I fairly suspect Kibaki does not give a damn about anyone else but himself. He may have hosted the thugs in SH as Waki said, but they can fairly count on being alone on this one. All said and done, raila and Kibaki will smile on and go on with life. |

Specualation is not a bad thing. Pinochet has been indictd. The Argentinaian dictator is being indicted. Mitterand wa Frace is in hot soup. Hata Benjamin Netanyahu ran scared to Washington when the SA judge released the atrocities he did in Gaza. Karadic, Taylor wako Hague. Bashir anajiharia kia siku...justice grinds slowly, but it surely works especially for the small fries like Kenya, Sudan et al...

@ Tickie
For someone who loved to torture his victims by plugging a firehose up their [censored] before letting it rip (Pinochet), or one who dipped his hand into the cookie jar all along his political career (Mitterand), and that flamboyant chappie who profited immensely (even funded at times) the diamond wars (Taylor) or that fella who uses Palestinians for target practice (Netanyahu) or that hardline hombre who lets genocide rip in his own backyard while pointing fingers at the West (Bashir) All these clowns have one thing in common - THEY WERE ACTIVELY INVOLVED. In my opinion, all Tinga wanted was to bring Kenya to a standstill and make Baba Jimmy uncomfortable - he didn't bargain for post-election violence. Unfortunately some of his lieutenants had grander ideas of the genocidal variety. They way those two have been buddy-buddy with Anan and Ocampo, you can't help but wonder, "have they cut a deal with the ICC Prosecutor?" Funny though, the only guy smiling at the impromptu Harambee House press conference on Thursday...was Ocampo.

For those thinking Kibaki is safe, he is not. Not about hosting Mungiki in statehouse, of course these are just nonsense. There is no truth in that. This theory was developed by the ugly Mkimwa et al (Nyongo)after the Kenugut oathing theory in Kericho.
Kibaki is guilty of complacency. Since there is no external forces (peace keepers) that intervened to stop the Killings, what was he waiting for all this time. Kibaki intervened to stop the Killings after the Kikuyus armed themselves and went on a revenge spree in Naivasha and Nakuru (God RIP all the innocent souls that died). That is when the army from Lanet baracks were sent to stop the Killings. After he stole and outrigged Rao, he had to legitimize his "victory" and this is why he was celebrating all along as Kikuyus continued to roast in the killing fields of RV. He is guilty for sitting in statehouse and hearing no evil and seeing no evil in the name of power.

I humbly beg to differ. There are many ways Baba Jims can argue this out. Thanks to Kriegler, 2007 was judged inconclusive -he could wiggle out of the "stolen" charge. Two, he could argue the logistical nightmare of policing the country with a threadbare security outfit. Kindly note that the man that brought sanity to the table (Anan) declared that "I am happy with the pace of reforms, but Kenya can do better." There are too many "if's", "but's" and "maybe's" to declare condemnation with finality.

those breathing easy that pnu is safer, hold your horses. ocampo intimated that wakis' report forms a basis for his cases. inside the waki report there is mention of individuals meeting in state house. just because mashadites are not trumpeting that point does not mean it not.
truth is truth, we dont need to keep reminding ourselves about it. but it has caught the eye of the prosecutor. i cannot waste my time and energies and creativity on the politicians who dont tickle my fancy. to me they are just like poop - not worth a second glance! True, but Ocampo ain't a one-track mind kinda fellow and knows that he has to view all evidence in its entirety.
I think its prudent to keep an open mind - I leave the "I-said-so-full-stop" "sweep-it-under-the-carpet" finality to those who don't care.
