If the nominations to local authorities Uhuru Kenyatta made as Local Government minister were "illegal", as has been argued at length in various fora, it stands to logic Deputy PM Musalia Mudavadi has also erred in confirming close to half of these irregularities.
lawyers have said the revocation of nominated councillors is open to legal suits.
The lawyers explained that under the local government act, deputy prime minister musalia mudavadi should have first given notice to the affected councillors.
Mr paul musili wambua, a city-based lawyer who is also a former commissioner of the constitution of kenya review commission, termed the revocations as unlawful and unprocedural. "the minister, despite having discretionary powers, should have served the councillors with notices over his intended action," said wambua.
He also took issue mudavadi, who is also the minister for local government, for sparing irregularly nominated councillors elevated to the positions of mayors, chairmen of councils and committee chairmen. The law society of kenya vice chairman, mr james mwamu, called for the revocation of the election of mayors and council chairmen.
