Default Kimunya request the president to get best Investigators - 07-07-2008, 01:46 AM

Kimunya has requested the president to get the best investigators in the whole world to come and investigate him and if found guilty he will not only resign from Ministerial position but he will also relinquish his MP position. This could take a new dimension against those who have been against the minister yet they were also part of the deal. Kimunya maintained Amos Wako, PM, Aaron Ringera and Orengo should also step aside for investigation since they had a stake in the sale of the GR Hotel.

Prof Ndung'u has also joined Kimunya in declaring GR was sold at best price. He also mentioned all relevant authorities had been informed of the deal, adding that a briefing had also been made to higher authorities including the prime Minister.

If PM new all this why then did he accept the role of forming a committee that is characterized by people implicated of graft including himself and is raila hiding something we don't know?

..even before we talk of whether Kimunya benfitted directly from corrupt deals or whether the govt sold the GR hotel at the best price,already Kimunya has broken the public disposal and procurement law which should land him in court..

FYI, GR was not a public property to be subjected to the public disposal and procurement law which has become a chorus.CBK (and in extension the public)was only a chargee rather than a trustee.Najua hiyo huyezi nyita inamean nini.All the same get your facts right.

ala..its you who needs to get facts right!! the issue of whether CBK was holding on to the hotel as security for the 2.5 billion pattni owed it has been made clear.

A High Court settlement on the 9th of April 2008 - [Civil suit 1111 of 2003( KACC vs Kalmesh pattni ) ] where the consent order read that Patni did agree to relinquish ,transfer ownership of the GR to the CBK ,

this summarily puts to rest the issue of ownership.

that means as of that day the property belonged to the Govt of Kenya via the CBK. - next is how does the government dispose of public assets ..? ( hint disposal & procurement act )

anyway besides breaking the procurement and disposal act and privatization act Kimunya has been acting in a very unprofessional manner e.g ignoring summons of parliamentary committees , lying blatantly in public about the involvement of the Libyan govt etc - thus he has broken the public officer ethics act law -

This time we need the president to act and act fast the political issues hitting the country are way over board, if we stand a chance to stay united then the president has to intervene. The grand regency issue was already known by the cabinet before the public, knew about it He need to have investigators to tell us and give us facts of what really happened to the sale of the grand regency

Kimunya is Kibaki's most trusted friend and ally - and I doubt he would do much, Kibaki was well in the picture of the fraudulent sale ,no way Kimunya would single-handedly undertake a sale of this magnitude without his knowledge just like he was during the anglo leasing scam ( when Githongo kept him updated )

Kimunya's arrogance and confidence clearly shows he has support from above

The best Kibaki could do is to "pretend to be sacking Kimunya" as a PR measure to hoodwink the public, and cool tempers then quietly give him back his job

The CBK was acting in its capacity as chargee and not a trustee of public assets. Thus it was neither bound by the public procurement and disposal regulations nor the privatization act. In disposing the property, CBK could only exercise its powers within the parameters set by the charge which was to sell either by public auction or private treaty. CBK opted to sell grand regency hotel by private treaty which is still within the law.

I think you are behind News, going by Consent Order registered in the High Court of Kenya on the 9th of April 2008 in settlement of Civil suit 1111 of 2003 ( KACC vs pattni + 16 others ).

Ownership was transferred from pattni to the CBK. It ceased to be a Chargee as of that date, but instead took over the hotel on behalf of the Government of Kenya.
