Best thing you can do is have the h1B holder go and get it for you !
they really won't ask alot of questions once the H1B is approved. This is due to the fact that it's a prerequisite !

Otherwise, there is no major obstacle as such ...you will need to prove that you are legally a dependant of the H1B holder..ie spouse or a child !
And also you have to bring along the H1B approval notices .. notorized copies of the previous tax return fillings if any.
And as always ... you need some luck !! you never jua with this folks !
