Far be it from me to condone impunity. We all know that what happened after the elections was one of the most devastating events to have occured in Kenya. In a perfect world, it would be wise and prudent to ferociously come after the men who orchestrated the mayhem that was visited on Kenyans. But this is not a perfect world. In deciding to walk away from the Waki findings, our elected leaders took only one thing into consideration...the impact of implementing the report.
There were two possible outcomes here:
1. By trying to implement this monster, the gentlemen who have been adversely mentioned in the report would not have taken it lying down. So what, you ask? Well, have you considered that these men are at the helm of tribal chieftaincies? Have you considered that as of now they retain the influence to destabilize major parties...and by extension the nation? That is a fact we can't just wish away. So if we come after these men we risk antagonizing whole communities and creating another round of ill feeling at a time when Kenya is evidently healing.
Let the healing prevail.
2. The other outcome would be that we drive the nails in the coffins of these guys and let nature take its course. If Kenya ignites afresh in an orgy of bloodletting, so be it. The problem with that thinking is that it undermines the peace we've worked hard to restore. I don't care what the U.S. and the German ambassadors say. What I know for sure is that when Kenya ignites, they'll send in American and German planes to whisk their nationals to safety. We don't have the luxury of listening to their misguided sermons. In anycase, when was the last time you heard ambassador Ogego tell the Americans how to run their affairs? And when was the last time you saw any of our ambassadors pretend to understand somebody's country better than the people who were born and bred there?
I detest the role these two men have played since the debacle that was our elections. I may disagree with Vice President Kalonzo Musyoka on other matters, but on this one I call on Kenyans to heed his advice...let's not open another can of worms foolishly. We must proudly take out matching orders from our understanding of our issues, our background and how they affect us. That's why we have brains.

The most fascinating thing here is the reaction of the majority of Kenyans mainly as could easily be gauged from sampling those who called in. It was clear that there is great anger against those who are rejecting the Waki report and by extension saying YES to impunity and its’ survival in the country’s political landscape. One caller put it very clearly when they said that it was unfair for the political class to reject the Waki report to protect their own when many ordinary Kenyans are still languishing in jail as suspected participators in the post election mayhem. So is this the justice that the political class are promoting in rejecting the Waki report?
Take note fellow Kenyans in all this sordid affair of the reaction of the political class to the Waki report, something has happened. A clear shift has taken place in the political stratosphere. This is the beginning of the end of old politics in Kenya. This is the end of ODM. This is the end of PNU. And most of all this is the end of impunity. Let us wait and see what will happen.

Although the family is promising to open up to the public after the elections, it is highly unlikely the jovial Kogelo villagers will ever again step into the currently-under-tight security-Obama-homestead, let alone see the Obama matriarch at the local market rendezvous, given that Obama has very high chances of emerging the winner against John McCain. (Make that a landslide!).
Information reaching this blogger indicates that Kenyan and regional security forces, working closely with American Secret Service and FBI, have put all exit points out of Kenya on HIGH ALERT following credible intelligence information indicating that the Al-Qaeda terrorist cell in Eastern Africa under the leadership of 10 years-yet- to- be arrested- Harun Fazul is planning a terrorist attack on local vital installations and Western interest in the Eastern Africa region. Mama Sarah is, according to intelligence sources, an obvious and vulnerable target!!!! Infact, the IGAD summit on Somalia taking place in Nairobi today is just but a smokescreen to have the Heads of State/Government confer one-on-one and face-to-face on the serious security threats arising out of the imminent Barrack H. Obama presidency in the U.S.
Interestingly, even the normally vocal and social US Ambassadors in the region (including our very own MR in Kenya) have ‘gone underground’ because the threats of attack are allegedly already in advanced stages and are aimed at petrol stations (forecourts in Western lingo) oil tankers and airports and other strategic interests. The attacks are allegedly planned to coincide with the US Presidential Elections in early November when the global attention will be singularly focused on witnessing the elections of a candidate whom the Al Qaeda are not supporting because his victory will mean end of the war. Not surprisingly, the public concentration in Kenya is expected to reach the same levels or perhaps exceed what was witnessed in December 2007 during the country’s own presidential elections.
As it is, the Al Qaeda group is reportedly already IN-REGION crisscrossing the borders and mingling with common mwananchi with intentions of identifying escape routes and camouflage.
Security has therefore been enhanced to an unprecedented level at all regional seaports, airports and border points while anti-terrorism vigilance is a step or two higher than usual. Accordingly, customs, immigration and security officers are having sleepless nights as we approach the D-day in the US.

Jitters In Kenyan Kitchen Cabinet Over An Obama Win

Insider sources inform this blogger that when the possibility of an Obama win was first brought up within the Kibaki kitchen cabinet months ago, it was dismissed outright. Somebody confidently predicted that Sanetor Hillary Clinton would win the Democratic party nomination to run for the presidency and that she would do it easily. Most of the old school members of this inner circle have visited the United States many times and some have even lived there and so they were pretty confident with their predictions. The general feeling was that there was no way the racially charged Americans could elect Barack Obama.
Well now there are serious jitters within this inner circle even as they remain completely puzzled and dumbfounded as to what the hell is going on. How can that son of a “Jaruo” rise to be president of the most powerful nation in the world? HOW???
In fact if I could talk to them I would tell them something else to completely bawl them over. My insider source in America (with decades of experience observing the politics in that country) told me last night that it is now looking like the first time Illonois Senator will win the presidency by a landslide. YES, I was stunned myself at this information and I still am.
But why should any Kenyan in their right mind not be happy at the prospect of the son of a Kenyan from Siaya becoming president of the most powerful nation on earth? The answer can be found in the complex cut-throat game of politics.
You see despite the so called Grand coalition government, the truth is that both the PNU and ODM factions within the coalition are still bitter rivals looking for the upper hand that will carry the day when the next general elections are called. It is no secret that the man who could be the next President of the United States has some very close ties with the ODM top brass. One just needs to cast their mind back to the Obama visit last year and the feathers it ruffled in the then Kibaki government to realize what I am talking about here. Don’t forget that President Kibaki flatly refused to meet with Senator Obama during that memorable visit. Now if Obama lands in the White House, roles will be reversed and it will be president Kibaki seeking audience with Obama.
And that is in a scenario where Prime Minister Raila Odinga regularly has cell phone conversations with Obama. Naturally this makes many within the president’s inner circle very jittery and hoping against all hope for some miracle that will see John McCain somehow winning.
What worries PNU insiders is that the president of the most powerful nation is well able to make decisions that could greatly jeopardize their well laid plans. In fact those jitters extend to most of the political class and those who have made their money through dubious means.

What Was Your Role In The Mayhem, Mr President?
» You Missed This Water Minister Charity Ngilu has a long history and reputation for speaking her mind and not caring too much about the consequences.
Now she is asking a very simple but direct question. What was the role of President Mwai Kibaki in the post election violence? Now before the tribalists come out heaving and breathing fire, let us pause for a moment of quiet sober and non-partisan reflection.
Kenyans are unanimous in agreeing that there should be no amnesty and that all perpetrators of post election violence should face the full force of the law. That is fine. But please remember that already many innocent Kenyans are languishing in jail for mostly being at the wrong place at the wrong time. And this was mostly because they happened to be poor. Quite a number of the guilty ones are already dead and some are already answering to their heinous acts in the courts. And all this is going on when none of the people right at the centre of triggering the whole mess are roaming the country scot free. Some of these people are now loudly asking for amnesty.

My nasty toothache experience

Folks please let us learn how to be a little sensitive. Imagine what those Kenyans who suffered greatly as a result of the skirmishes feel when they hear the word “amnesty.” Those whose nothers. Sisters, wives and girl friends were brutually raped. Those whose loved ones were killed as they watched. Have mercy. Don’t you think that the call for amnesty is making them live through the nightmare all over again?
We said in this blog very early on that election violence perpetrators should either all be prosecuted or all given amnesty. In other words there should not be any selective justice. Especially if that justice is meted out Kenya-style where there is a very different way of handling the poor while the rich mined and political class can never seem to be touched by the same law.
Now the truth of the matter is that the whole post-election violence horrors were triggered off by a stolen election. So justice must start where the problem started surely. What makes this whole thing even sadder is the fact that those close to the president and indeed the president himself were fully briefed (if we are to believe the NSIS) on the consequences of election theft. But still they went ahead and to make matters worse, without taking the necessary precautions to limit the loss of human life. Indeed there is evidence to suggest that certain arms of the security forces deliberately went out to kill, the objective being to scare demonstrators and other would-be trouble makers from escalating the violence. Well this plan fell flat on its’ face and what saddens me the most is the fact that one of the reasons why this happened was that those making decisions had no idea at all where the masses of Kenya are coming from and the kind of suffering going on within the borders of our beautiful country just because of impunity and bad politics.
So Mr President, even as you suddenly shift gears about this amnesty thing, please tell us, what was your role in the post election violence. Plenty of innocent blood belonging to Kenyans is crying out from the ground for an answer to that question.
Again I ask, what was your role Mr President?

WAKI Report: The Perpetrators of the Ethnic Skirmishes must be brought to Book

The fact that the findings of the Waki team have revealed some very incriminating evidence against leaders in both PNU and ODM, is a very clear indicator that the mayhem that engulfed Kenya early this year was meticulously planned by the rich political and business elite. And as the saying goes, ‘The guilty ones are always afraid’. This explains why some politicians are in an inexpressible state of panic while others have in no uncertain terms trashed the Waki report.
In as much as it is important to forget the past and think of how best to ‘build a New Kenya’ , it is also imperative that we bring to book both the financers and the perpetrators of the atrocious acts for, if we let them go scot free, that would be tantamount to sowing seeds of impunity. It is no doubt that gross crimes against humanity were committed and all the people who aided and abetted the murderers, regardless of their stations in life, must be tried by an International Tribunal.
Every right thinking kenyan should therefore call upon President Kibaki and Premier Raila not to allow the tempering of justice with forgiveness. Everyone must carry their own cross. We must not allow ourselves to be blinded by barbarism and stupid ethnicity. It is high time that we accepted that Kenya is a multi cultural society and that the basic tenets of true Kenyanness lies not in our tribes but in our resolve to invalidate all stupid value systems that are aimed at dividing us along tribal lines. It is time that we understood that our Luoness, Kambaness, Turkananess or Mijikendaness is nothing but a biological accident for, nobody, even the high and mighty sent a telegram or an sms to the Creator asking Him to create them in this or that tribe.
Folks, we must not allow the barbaric philosophies of politicians to fill our heads with negative ethnicity, abhorrence and bloody pettiness. We must understand that politicians play the tribal card to their advantage and not for the benefit of the poor youths who kill and maim at their behest. I would like to pose this sixty four thousand dollar question to all Kenyans: What have we got to show for our barbaric acts? The whole world had held us in such high esteem and we were all proud to be called ‘Kenyans’ before all the hell broke loose. Now, when incidents of utter stupidity and unfathomable barbarism are mentioned anywhere in the world, the Kenyans in diaspora bow their heads in shame as the ethnic cleansing in Kenya is cited as one of the most barbarous and unfortunate incidents to have happened in a civilized country. Fellow countrymen and women, are the people who visited terror on their innocent neighbours not poorer than they were last year? What about the politicians? Has any one of them gone to bed hungry? So, we are fools, aren’t we? If we are not bloody fools, tell me folks, why then did we arm ourselves with all manner of crude weapons and went on the rampage just because some sick barbarians told us to do so? It is an open secret that our blood is sweeter than honey to the politicians who ‘drink’ it and we must say an emphatic “no” to politics of barbarism and blood letting.
It goes without saying that the effects of the post election violence on the economy of this country are unfathomable. Schools, hospitals, roads and railways and farms were destroyed and money that would have been put into better use has to be used to try and clear the mess. How then can we say that these people should be forgiven? If these shameless people are not made to account for their acts, tribal skirmishes will become the norm rather than the exception. We must not allow forgiveness to entrench impunity! The verdict is out; all the murderers and their political godfathers must be tried and punished for their sins.

The Reign of Armed and Uniformed Impunity
» You Missed This As the Waki flame continue to gather more powerful wind, Kenyans are conveniently focused in discussing the post-election violence without pausing to ask the tough and simple question of the root cause. Well, talk is cheap and weak minds are prone to bandy epithets at each other oblivious of the consequences.
Give Kenyans a new constitution that entrenches institutionalized governance and nobody will care a whiff about the tenant at State House. What is more, the respected address will no longer be reduced to a rendezvous for militia planning to murder Kenyans. But that will remain a coloured wish given the aging scoundrels masquerading as our leaders. Last year’s bungled elections only provided the spark that ignited a hitherto simmering time bomb.
The impunity monster that is currently mauling Kenya was conceived by Kenyatta, weaned by Moi and married off to Kibaki. Between these three devils lies two communities who have the highest political stakes and numerous scores to settle. Forget about the Luos, Luhyas and Kambas (not to disparage other 30+ Kenyan tribes). These are three only serve the purpose of completing the quest equation to join to the club. The hatred and occasional embrace accorded to these later three are mostly premised on the Machiavellian doctrine of doing all it takes to demonize a competitor or co-opt as a ladder to the top.
The list in the Wakis’ envelope and the KNHRC original (not the THIRD version) reads likes who is who among the Kikuyus and Kalenjins. It is no coincidence that Jomo Junior tops the list. He has plenty at stake personally and communally and above all else the family name to both protect and expand. And Ruto? Well, the Kikuyus will drop his name in their day time dreams in the belief (real or perceived) that he stand between them and political supremacy.
As much as we would wish to bandage the festering wound, LAND remains the root cause of all the souring political temperatures. Kenyatta grabbed all the prime chunks of Kenya to his fill creating the Kikuyu Diaspora mainly in the rift Valley. Owing to his own insecurity, Moi made unchallenged political supremacy his principal objective for 24 years.
When naive Kenyans thought they had banished personalized selfish rule to hell in 2002 they had no glue that Kibaki had his own unfinished business and dream to fill. Unfortunately that dream was at variance with his voters save for his few supplicants. The rest as they say is history whose text we are painfully living now.
Postponing Armageddon
Times have changed and the Kalenjins will not buy the naive crap of willing-buyer-willing-seller. The superiority complex only helps in boiling the rage. Having both tasted personalized power, the Kikuyus and Kalenjins are simply playing political checkmates. Back to the trenches they will both do anything to reclaim or retain it power. And no price is big enough to pay in that pursuit.
The Kalenjins are (rightly or wrongly) bitter with Kibaki’s orchestrated resolve to cut them to size during his first term as president. On the other hand the Kikuyus are cursing in arrears Moi’s determination to incinerate their hitherto political and economic advantage.
It may sound like a cliche but the truth is that after last years bungled elections Kenya will never be the same again, NEVER. Kibaki’s penchant to resort to the tried and tested political games dolled in stereotypes became his Achilles heels when he underestimated the resolve of Kenyans who know what they want and they are determined to get it at whatever price. The era of using power to selectively reward and punish is gone forever and the sooner the dinosaurs knew that the better.
No amount of uniformed and armed impunity will kill the will of a population determined to regain their right to choose the way they are governed. Only a new constitution reflecting institutionalized governance will save us from the imminent jaws of apocalypse.All else amounts to pretence whose only success is guaranteed in postponing the inevitable.
No wonder Justice Waki's wisdom informed him to ignore the sovereignty balderdash by handing over the secret envelope to Kofi Anna. Message: you can run but not hide.

SCHEDULE OF ALLEGED PERPETRATORS
CAUTIONARY STATEMENT
The Kenya National Commission on Human Rights (KNCHR) recognizes the existence of the culture of impunity in Kenya and the need to remove this shield. In the preceding chapters of this report, the KNCHR has made key recommendations including calling upon the Attorney General of the Republic of Kenya and/or the Kenya Police Force to undertake further investigations on various issues that the Report raises. In this section, we provide a list of alleged perpetrators, who were mentioned by interviewees as having played a role in the perpetration of the post election violence. The list is not comprehensive and does not present a complete picture of all who may have been involved. It makes mention of various alleged perpetrators and includes some background information on them, and the allegation(s) and information supporting the allegation(s), which the National Commission believes provides a basis and a good starting point for further investigations.
Every effort has been made to ensure that the information supporting the adverse mentions reaches a threshold that had been agreed to (see Page 20 in Chapter One).
The National Commission is not making any conclusions that the persons mentioned here are guilty; this is presented in the effort to remain faithful to hundreds of Kenyans who provided this information which we expect that the relevant agencies will further
investigate.
On many occasions unsuccessful efforts were made to contact those mentioned. In particular, given that this was election related violence, the Commission sent out letters to all the members of parliament, which however elicited very few responses.
The list was subjected to review by independent persons at the different stages of compiling the report including by the staff and commissioners as well as by national experts contracted by the National Commission to review the report and critique the same.

On the third week of January 2008, she attended a purported peace meeting at Manaret Society, and incited the local community after which a vicious attack against the Kisiis was instead intensified.
Together with Franklin Bett they talked to and incited about 700 youths at the Sotik Tea Estate and immediately they left the youths began to burn houses belonging to Kisiis.

During a public meeting in Kiptororo in Kuresoi in December 2007, he reportedly urged the Kalenjins to fight the Kikuyus until they leave Molo area.
Before elections, he and other prominent politicians attended a meeting in the interior Ndoinet forest. After the said meeting, the group that attended attacked and destroyed properties belonging to the non Kalenjins. It is believed that they incited the locals to attack non Kalenjins.
He brought young men (boys) in groups of more than 300 from Bomet who worked with the Luo locals to attack the Kikuyus.
Together with the late Kipkalia Kones and the late
Kimutai Too they financed the Kalenjin youths who
attacked the Kikuyus and Kisiis in Kericho.
He organized youths to attack the Kikuyus and
Kisiis in Kericho. He gave them transport, fuel and
food and held meetings at Kericho Tea Hotel and
other places.
He told supporters that “all the investors in
Kericho and in the estates will be either Kalenjins
or Indians”. This statement is said to have given
the youths motivation to attack all other tribes
especially Kisiis and Kikuyus.
He is said to have been explaining to people who
attended a meeting at Kipkatet that no one can
take what belongs to the Kalenjins, especially land.
In a meeting held in Chopkoibet in Bomet, he is
quoted to have said that “ he will beat up the
Kikuyus till they leave Molo”
Together with the late Kipkalia Kones and the late
David Too, they organized and facilitated the
youths to be transported from Trasmara and
Bomet by lorries through Silibwet to go and chase
Kikuyus from Kuresoi.
He intimidated people at Kericho Police Station
and told them that those that give information to
investigators on post election violence will be
lynched.
Eye witnesses have reported that on the 30th of
December 2007 at around10.00 am, at the Caltex
Petrol Station in Kericho town, he gave
unspecified amount of money to some Kalenjin
and Luo men who immediately after the said
payment started stoning and burning kiosks
perceived to be owned by Kikuyus but were in
actual fact owned by the Kipsigis and the Kisii
people.

On the 23rd November 2009 went to Stagemart in
Kericho and addressed a crowd asking residents to
remove all the stains/spots (madoadoa) from the
region. In January 2008 he asked that all the
stains/spots (Madoadoa) be removed from the
region.
Together with Kipkalia Kones and Franklin Bett
they financed the Kalenjin youths who attacked
the Kikuyus and Kisiis in Kericho.

5. Hon William Ruto MP, Eldoret North Constituency,
Minister
Planning, incitement, and
financing the violence
In August 2007 he held a meeting with other
senior ODM leaders in Kipkelion near Kericho
including Sotik MP the late Lorna Laboso , the late
Kipkalia K. Kones (Bomet), Kiprono L. J. Magerer
(Kipkelion) , and Franklin Bett (Bureti) where the
leaders resolved to carry out mass evictions of
non Kalenjins from ‘their’ Rift Valley areas,
particularly the Kikuyu and Abagusii.
During an opening ceremony for the Seventh Day
Adventist Church in a place called Mailing, he is
alleged to have said that they would uproot the
“sangari”, ‘shake off the soil’, ‘gather it together’
and ‘burn it’, in reference to ‘outsider’
communities. .
He is alleged to have addressed the public at
Bisabol shopping centre in Turbo near Burnt
Forest and incited the local Kalenjin and Luhya
communities against the Kikuyu.
At a meeting on 22/12/2007 at his home in Sugoi
said that his headache was Mr Jonathan Bii, his
opponent, who supported Kikuyu on the land
issue and directed that they should be attacked if
they dared campaign in the areas.

At a meeting, he said that he would remove
Kikuyu and Kisiis from the area after elections.

councilors and other opinion leaders at Septon
Guest House within Septon Estate. The meeting, it
is believed, was for planning and organization of
the violence.

During the 2007 election campaigns, William Ole
Ntimama reportedly incited the Maasais in Narok
against the Kikuyus and Kisiis. He told the Maasai’s
to evict the said communities if they did not vote
for him and ODM.
On or about 30 December 2007, the Narok market
was burnt and several people injured after he
allegedly told Kalenjin and Maasai youths that the
Kikuyu women in the market had insulted him.

public meeting convened by the Kamara
District Officer held on 27/11/07.
Cheruiyot further reportedly incited the
Kalenjin parents to withdraw their
children from Sirikwa Primary and
Secondary Schools. As a result the
Secondary school was reportedly closed
down.
32. Joseph Rotich a.k.a Survivor. Ass. Chief of Mawingu sublocation

He severally threatened the Kikuyu
residents in his area that their time was
running out and that they would be taken
back to central province. On 4/10/07, he
was said to have publicly told the
residents of Murinduko farm that the
Shopping center would be burnt down
soon. After two days, there was an attack
at Murinduko Trading Center by Kalenjin
raiders but they were repulsed by the
Kikuyus. A month later (25/11/07), there
was a major attack in Murinduko during
which two elderly people were killed by
Kalenjin raiders. When Murinduko center
was finally razed down on 16/1/08, Mr.
Rotich was spotted among the raiders
near Set Kobor farm. After the Trading
Center was burnt, Murinduko residents
fled. Mr. Rotich was reportedly heard
bragging that his word that the Kikuyus
were going to move to Central Province
had been fulfilled. He said that he was
going to ensure that all Kikuyus fled to
Kiambu and Nyeri.

It is alleged that with Enoch Sugut, an
ODM youth leader and Headmaster of
Kaptebee Secondary School and Solomon
Tilawen, an ODM activist in Turbo, Faruk
Kibet allegedly asked two youth leaders
Mr Enoch Sugut and Solomon Tilawen to
organize the youths into battalions for
the war. Further, he allegedly requested
the youth leaders to enroll more warriors
as they waited for instructions..
On 2/1/2008 at Chepsaita in Ngenyilel
Location, accompanied by CDF Treasurer

Kikuyu and PNU Supporters residing at

Aiding and financing the violence. She is alleged to have given out her
incomplete house in Marura for night
meetings to plan attacks and also allowed
part of the incomplete house to be used
for making of arrows for the attacks.
She is also alleged to have provided
lorries to ferry youth from Moiben to and
attack Kimumu and the surrounding
areas.
90. Mr Jackson Kibor
A wealthy businessman and elder. Addressed youth and urged them
to attack and evict Kikuyus on
several occasions during the
violence.
Youth assembled at his home and later
marched to Maili Moja shopping centre
where he addressed them on 30th
December 2008 at 5.30 pm. He also
addressed a bigger number of youths in
his home on 1st January 2008.
He supported violence on BBC and tried
to justify the actions in the interview.

together with Abraham Chemen, (a
construction worker in Tambach), Bobon,
Raymond Mebar, and Kibiyego (a
neighbor and a medical worker at
Kakuma refugee camp in Turkana
district).
He was the custodian of funds that were
used to pay the attackers and generally
carry out the attacks.

his fellow Kalenjins why any Kikuyu

reportedly hosted and paid the raiders.

During the campaign period, he issued
threats to a Civic aspirant who vied and
worn a civic seat. He told him that he
should stop vying for the seat or else he
faces dire consequences. His house was
raided by police after an attack in Giticha
farm sometimes in November 2007.
During the attack, some raiders were
killed by the police. The police then
proceeded to Chumba’s house where
they reportedly found a group of raiders
preparing to take tea which had been
prepared using big sufurias (cooking
pots). It is alleged that the police found a
dead body in the house. Chumba and the
raiders were arrested but were shortly
released reportedly upon the
intervention of Hon Moses Cheboi.

premises to organize attacks. In August
2006, he was arrested by Kikuyu youths
during an attack by Kalenjin raiders in
Murinduko but was released shortly. He
is very influential and commands huge
support from the Kalenjins.
On 28/11/07, hundreds of Kalenjin
youths gathered outside Tito’s shop. They
later threatened the witness and crossed
over to the neighbouring Murinduko
farm and began attacking Kikuyus who
were attending to their farms, killing two
elderly people.
141. Joel Toweet Farmer at Set Kobor Hosting attackers and planning

According to witnesses, Joel’s son,
Vincent Mutai was killed in 2006 during a
cattle rustling incident at Tegea farm. He
accused Murinduko people of being
behind his son’s death. He used to drink
beer at Murinduko center and severally
threatened to avenge the death of his
son. Prior to an attack at Murinduko farm
on 28/11/2007 during which two elderly
people (Daniel Waruhiu and Susan
Wangui) were killed, raiders were
spotted meeting at his residence.

» You Missed This The Waki report is one document that will not fade from our national radar in a hurry. It has rattled many political interests and true to Kenya’s tradition expediency has taken centre stage with the two major political camps swapping positions. In the process more heat is generated leaving no trace of light in the whole process.
The Hague Express is patiently waiting to be flagged off with nobody ready to board. Well, they may not willingly board but all the kicks won’t deter ICC from claiming its scalp when the right time comes. The stakes are high and the two principals are held hostages by their sub-principals whose are hands are believed to hold the political asset of votes. So who will blink first?
Kibaki cannot afford the unforgivable and politically blasphemous act of dragging Jomo’s name in murk. With Jomo Jr topping the list in Waki’s envelope, leaving him exposed to face the laws of nature and vultures amounts to Kibaki aiding communal political suicide. The tower of Babel and economic hegemony thriving on his presidency would crash tumbling down like a pack of cards. Jomo’s skeletons must be rattling next top Parliament building at the prompting of the worms threatening to escape the can enmasse.
Then enter Bill Samoei and the stakes hit the skies. To him Waki’s margin of error is so large that he missed the boat by a whole river. And true to Kenya’s time tested gimmicks he has the Rift Valley brigade breathing fire with flaming brimstone. Now Waki’s report has been trivialized into a mere list hosted in an envelope.
Postponing inevitable apocalypse
With State House named as a principal address where the massacres were planned, can Kibaki afford to place his own head on the chopping block? And while at it, can Raila afford top purchase the politically expensive option of doing what is right no matter the fallout? Well, your guess is as good as mine and Kenya’s history bears us out. We haven’t seen anything yet.
The truth is that the present political theatrics are mere motions cleverly crafted to create impressions of movements. We have been up these roads and our smart politicians are aware of our naivety and short memory. Not this time. The average Kenyan is in such a foul mood and the world has changed so much so that Kenya will never be the same.
Even such high-sounding calls for a Truth, Justice and Reconciliation Commission will be clearly seen for what it is smokescreen to buy time. The lives of over 1500 Kenyans were not lost in vein. The masks are off and the politicians may thumb their chests all they want but the cheap tribal games are definitely over. They will only succeed in postponing the inevitable.

So Justice GBM Kariuki steps out of his official (tax payers) Mercedes Benz and engages his primitive instinct to stab Robert Karori in the stomach and still keeps his job as dispenser of justice? Some things can only happen in Kenya. But again IMPUNITY has become our middle name as a country.
It will come as no surprise to see people here predictably shouting presumed innocent till proven guilty. Being a High Court judge requires and demands purity and clarity of both character and thought. All the legal tribunal niceties only soothes egos at the expense of bloodying public opinion which is everything when it comes to matters judicial.
It takes superlative imagination to comtemplate an a robbed murderer convicting a petty thief in Kericho court tomorrow. Well, with the top leadership epitomizing impunity personified, Justice Kariuki is in safe company. The Chief Justice who is constitutionally mandated to write to Kibaki about Kariuki’s conduct and recommend a tribunal is himself a master of the same malice as evident in his midnight swearing in of the duly elected.

Civilized societies respect and remain sensitive to the court of public opinion. Thank God we have never even pretended to subscribe to membership of such a society. Deep Inside The Secret PNU And ODM Kitchens
» You Missed This While President Kibaki and Prime Minister Raila Odinga are busy telling Kenyans how the government of National Unity is solid and united, behind the scenes deadly daggers have been drawn and it is possible that very soon we will see some major turmoil on the political front.
Interestingly both sides of the political divide thing that they have outsmarted the other. I will reserve my controversial but well thought out verdict for the very end. After I have told you what they are saying and doing deep in the kitchens of PNU and ODM.
The plan now in the drawing boards of PNU insiders is to look for a way to put a spanner in the works to bring down the government of national unity. The motive is simple. They have carefully gone through the Anan laws with the help of lawyers and it is clear that in the event of the GNU collapsing Kibaki remains president and has the power to re-constitute a new cabinet. The PNU think tank s confident that they will be able to easily pull this one off because they say that they have well-documented evidence of corruption amongst the top ranks of ODM (more details in my raw notes to be released tomorrow). Interestingly ODM, as brilliant as their think tank is, has not been able to document much on the PNU side in terms of evidence on corrupt deals.
So the plan will be to leak the evidence to the public which I am informed will cause serious outrage and great disappointment even amongst ODM diehards.
The truth is that the Anan deal greatly favored PNU and ODM was short-changed in many ways. This is what PNU insiders are looking to cash in on.
It is not clear what the effect of the break up of the GNU would have on the general public. Most Kenyans are really sick of the current crop of politicians and Kenyan politics as a whole so the truth is that many will be delighted to see the GNU collapse. The only problem is that the alternative (a Kibaki cabinet) will not be acceptable to many. We know for instance that the warriors in Rift Valley have not disarmed. We also know that groups sympathetic to the PNU cause have been heavily arming and swore earlier this year never again to be caught unawares. That is the reality on the ground.
But as usual PNU insiders seem to have miscalculated and have probably not fully considered the repercussions of a re-constituted Kibaki cabinet.
As much as I have no love lost for the greedy selfish insensitive GNU, I shudder to think of what any alternative may bring.

Kibaki: Forgive My Criminal Negligence and Move On
» You Missed This Either Kibaki must have been religiously reading Kumekucha or thinking on the same wavelength as his apologists here. This may be the only way to reconcile his attempts to give national wings to the MOVE ON mantra. He started it over the weekend in Nakuru telling the IDPs to forgive and promptly made it the central plank of his Kenyatta day speech.
Ours is a country raped of any future and crying for direction from scoundrels with no BALLS to take challenges head on. Instead they perfect DECEPTIVE maneuvers to bandage national wounds that will surely consign us collectively to septic trauma. But you cannot blame nor envy Kibaki given the fact that Waki and Kriegler report both point fingers at two institutions at the heart of his fraudulent presidency. Before you shout stuck record please tell that Waki who has also chosen to address the cause and not cherry pick symptoms.
The heads of ECK and the police force are human and would not go down with a fight. The cupboard is full of skunks whose order is guaranteed to intoxicate all and sundry. The stinking details are too scary to imagine and faint hearts would better do with amnesty which they have been all hitherto opposing before the mask was removed from close buddies who schemed and financed murder of fellow Kenyans within the hallowed precincts of State House.
Kriegler may have been too cautious only sticking his neck on ECK. But not Waki who went the whole hog and looked the horse in the mouth and called it bluff in three apt words, IMPUNITY, IMPUNITY and more IMPUNITY. Expecting the same person who personifies impunity extraordinaire is not only naive at best but akin to recommending self-amputation of your very limbs at worst.
Unbreakable Hague noose
Poor Kenyans, we are stuck in a rut as we remain collectively hostage to poor, deceptive and fraudulent leadership whose singular agenda is to auction every facet of our country to the highest bidder. The supporting acts of Libyans have had their paycheck and so do Ugandans. Meanwhile Kibaki only remains comfortable with tried and tested fear of the unknown by selfishly cautioning that implementing Waki and Kriegler recommendations will plunge Kenyan into further into acrimony. For Pete’s sake we are at the bottom of the pit and we cannot fal any deeper.
Even Kofi Annan concurs that our problems are all rolled up in IMPUNITY and preaching forgiveness will only succeed in entrenching the same beast. We cannot afford the luxury of Moi-like hollow slogans of peace, love and unity. But thank God for small mercies. Waki must have foreseen the dithering and playing dice with Kenyans’ lives.
Waki's Hague option is not only LETHAL but a masterstroke and timeless too. Kibaki is better advised to act now when he can use incumbency to manipulate things in his favour. Gerrymandering will only see him plucked from Othaya to the Hague Charles Taylor style. Time is priceless and Emilio cannot buy in this case.

» You Missed This Remember Mugoya Constrution? Remember the numerous cases the company faced and even court appearances of the proprietor, Ugandan James Isabirye both in Kenya and his home country of Uganda?
Mugoya construction was also mentioned in the Kroll report and everybody knows how political connections and kick-backs were used to great effect to help the company look like it was the only construction company in Kenya at the height of the Moi era. Let me take this opportunity to announce to Kenyans that Kibaki’s first government was much better and the corruption currently going on is making that administration even with Anglo Lasing hanging over it) look as clean as a Sunday school class. Folks, what is currently going on is a feeding frenzy. Most of your beloved politicians in the grand coalition government are very busy building war chests for the next general elections. They are in a terrible hurry because nobody believes that the next elections will be in 2012. Everybody knows that they will happen much earlier.
The amazing resurrection of Mugoya construction should tell Kenyans a lot. There is no doubt that it is linked to 2012 and the war chests being put together.
My sources tell me that Mugoya is involved in the Nairobi-Mombasa road project. Yes that major highway in Kenya that never seems to be completed although there is some semblance of work going on and construction is so slow that tourists have to shake their guts vigorously when going to Mombasa by road. Mugoya was squeezed into the project under very mysterious circumstances because another company has always been and still is the main contractor. Sources on the ground say that the company is building bus stops and taking care of other “special features” on the road. Wow!!!
I am also informed (and I am verifying this information) that Mugoya is very heavily involved in some hefty contracts in the Prisons department. In fact I am told that Mugoya are heavily hiring (casuals) at the moment. What all this means is that it is now business as usual at Mugoya.
How did this happen under the nose of the grand coalition government? I mean Kenyans are already reeling under the extremely heavy weight of supporting this bloated government and then these chaps are adding insult to injury with their corrupt ways. Where is the Prime Minister? Is there anybody who can stop the feeding frenzy currently going on and clearly illustrated by the return from the grave of Mugoya construction?

Waki Shames the Devil, Starts War on Impunity
» You Missed This Justice Waki has proved being Kenyan and having his fingers on the country’s pulse. While Kriegler skirted around the causes post election violence, Waki and his commissioners have not only named names but
let a noose hanging precariously over the present kings of impunity.
At the heart of Waki’s recommendations is the resolve to address IMPUNITY as epitomized by Kibaki’s regime. Faint hearted Kibaki’s political apologists may not like it but reading Waki’s report leaves no doubt Kibaki is singularly to blame for his singular resolve to concentrate on bungling last year’s elections having known before hand the outcome.
That anything premised on DECEPTION is eternally unsustainable couldn't have proved more true. No amount of serial and shameless propaganda that Kibaki's cronies crafted to dovetail into tribal stereotypes will wash. The facts are stack and Waki has tactfully given Kibaki the leeway owing to FRAUDULENT incumbency to clear his act for a better Kenya.
The Hague option was Kibaki to fail in setting up a tribunal to try and punish IMPUNITY is not an empty threat. With daring Hague prosecutor Ocampo Moreno breathing fire on neighboring Bashir, the stakes couldn’t have been higher. Waki has expertly managed to juggle diplomacy in calling his appointing authority bluff without loosing sight and fidelity with the truth.
No more gimmicks
Waki has measured up to the calling and expectation in telling the king he is nude and not immaculately dressed as his cronies would want him to believe. But don’t count your chicks yet given Kenya’s reputation to defend the impossible. Soon we won’t be surprised when PNU troops start trumpeting Waki’s report as revenge act to his dismissal from the bench on corruption allegation which he successfully challenged before being reinstated.
Whatever the gimmicks, Waki has started the guillotining machine rolling downhill and beckoning our masters of impunity. By indicting our security agencies for their role in murdering people they are employed to protect, Waki has left no doubt where the buck stops.
Waki’s verdict disabuses us of the hitherto penchant to embrace anything from outside especially from the so-called whites. The die is cast and the reign of impunity is speedily hurtling to unceremonious and shameful demise thanks to Waki’s selflessness.
Time is ticking and soon there will be no corners (commissions) to cut. Waki's commission is like no other and the circumstances have dramatically changed. The cumulative wages of national sin is simply incalculable but somebody must pay. It only remains a matter of when and not if.

Matatu-Riding American President And The World Economic Melt Down

No previous American president has ever had to face what Obama will have on his plate in a few months time. While I wish him the best and will be rooting for him all the way, I just wonder…
Obama’s ascension to the highest office in the land will also mark the most dramatic shift in the fortunes of Africa ever witnessed in history. There are some economic pundits who believe that the world economic melt down is already ushering in a new world economic order that will greatly favor Africa for the first time. Personally I see plenty of evidence to support that kind of thinking.
Kindly bear with me for a few minutes. I know how boring economics is, more so in a hot political site like Kumekucha, but I believe this is important.
This is the second time that greed and speculation are bringing the world economy to its’ knees. Chances are that we may just go back to the old ways like having gold in a central bank to back the currency out there. My view is that the sophisticated bail outs will not work and that even if there is a brief initial respite, things will only get worse.
Africans are poised to be major players in the world economic order because trends clearly show that food prices will continue to head North and since the continent is primarily agricultural country, I see farming becoming more profitable than it has ever been in history. Then there is the continent’s highly skillful labour force that has for a long time been locked out of Western economies. Whatever happens, that valuable resource will greatly benefit the continent in the years to come even if it is in the form of repatriated earnings (although I have a feeling that it will be much more than that). In Africa Kenya is clearly the country to watch here.
Then there is the World Wide Web and the cell phones which have given Africa instant infrastructure that is already fuelling unprecedented economic activity on the continent.
The world as we knew it has changed forever and Africans and especially Kenyans need to follow Senator Obama’s example and rise up to the occasion. This is our time.

Verdict: The Hague is Beckoning
» You Missed This Justice Waki may have tempered his language to avoid bruising political egos, but the thrust of his verdict lies in the fine print that most Kenyans will conveniently ignore as they shout themselves hoarse in chasing shadows. The report lays bare the root cause of post election violence as LACK OF LEADERSHIP that is/was singularly enshrined in IMPUNITY. But trust Kenyans to shamelessly cheer their tribal chiefs even when they are all collectively led to the edge of a cliff.
The verdict on NSIS is damning. No country runs without a dependable intelligence service and ours is reputed as one of the best on this side of the planet. The NSIS knew about the suffocating tension before the polls but their interest rested elsewhere secure in the knowledge about the voting pattern and outcome. Gichangi and his team disregarded professionalism to pay back the piper. His only grave mistake was use of old models based on stereotypes while chronically underestimating the resolve and anger of Kenyans collectively.
The truth is that right from 2005 referendum, Kibaki knew his political fate and he consequently played it safe while scheming to have the last laugh. Not until events took unpredictable turn and not even the NSIS could sermon any quick fix from its reservoir of magic in containing the fast escalating superhighway to apocalypse. Waki has painted it in black and white that Kibaki obtusely failure to offer POLITICAL leadership in his first term as president.
Waki couldn’t have been more candid. Our problems were more political than anything else. And the good judge didn’t mince his words in declaring that Kibaki failed to unite the country. Instead Emilio and his cronies allowed feelings of marginalization to fester into the inevitable post-election violence. The import of that is that Kibaki’s actions and omissions raped him of moral legitimacy which fueled national animosity only in need of a less than civilized contest to explode. And in deed we have lived to tell the story.
So what next or where do we go from here? Well, nothing and nowhere actually. Our short memory and selfish clarion call to MOVE ON will soon relegate this explosive report to the archives. We have no institution to speak of and the office bearers have no legitimacy either. We remain a country held hostage at the whims of scoundrels hell-bent on feathering their nests at our collective peril. Maybe by tracing the origins of PEV to 2002 MOU, even Waki refused to move on. On the contrary he is latently warning about the perils of DECEPTION.
Handsome rewards of impunity.
Even the cabinet’s adoption of Kriegler’s report was a gimmick to create an impression of motion with no commensurate movement. The composition of the sub-committee couldn’t have been more revealing with the same faces still smarting from distrust and raw anger at each other. The headlines may as well be the apt obituaries of these reports.
With no political or moral BALLS to confront challenges, the present leaders have bequeathed on us the curse of living a national lie in postponing Armageddon. But the truth never mutates and the lives of more than 1500 Kenyans were not lost in vein. Well, cheap political shots often derive pleasure in trivializing those lives as mere statistics with their pedestrian accusations.
Nothing lasts forever and one day and very soon the real perpetrators of these murders will ultimately pay for their crime singularly or severally. It is only a matter of time and only a Nairobi or Hague tribunal will appease those departed souls -
What Those Campaigning For 2012 Do Not Know
» You Missed This In the relatively calm political waters that is Kenya these days, Prime Minister Raila Odinga kicked off the storm by saying in a thinly veiled barb aimed at his political rival Kalonzo Musyoka that politicians should concentrate on service delivery to the electorate rather than in campaigns for 2012.
Vice president Kalonzo Musyoka replied quickly trying to deflect the barb by saying that he too thought it was a bad idea to campaign now for 2012 when the electorate were waiting for service delivery. The VP licked his lips as he usually does and said nothing but repeat what the Prime Minister said (some strategy). But this was the comedy of the absurd because the truth is that the Vice President has been campaigning hard for 2012.
But the most interesting and brave comment on the issue came from Justice Minister Martha Karua (that woman has balls I tell you). She declared that she was well able to work for the people and at the same time continue with her presidential campaign for 2012. She emphasized that those complaining were running scared concerning her presidential bid but that would not stop her (and her so-called unstoppable march)..
Gacoka MP Mutava Musyimi jumped into the fray and said that it was very wrong for politicians to start campaigning for 2012 when they were yet to fulfill the current mandate given to them by the electorate. The reverend implied that it was bordering on the immoral to do such a detestable thing.
In the midst of all this, too many of the usual loud mouths were silent. And their silence is deafening. But I am getting ahead of myself. Let us first examine this issue of campaigns for 2012.
The truth of the matter is that as much as I admire Martha Karua, I am a little surprised that she has not stopped to ask herself why she is dancing herself lame on an almost empty dance floor. Why is it that the dance floor seems to be so empty? Apart from the man at the corner there licking his lips as he talks unconvincing sweet nothings, as usual (the honorable VP who is the least popular presidential candidate to have ever contested the presidency from Ukambani ever since the late Paul Ngei made his attempt in the 1960s with his Akamba People’s Party) the floor is empty.
For somebody contesting the highest office in the land, Martha whom I greatly admire for her courage and achievements as a woman however seems to have very little “feel” for the true mood in the country. Kenyans are not only not interested in these presidential campaigns that are said to have started, but they are disgusted and fed up with the political class as a whole.
The reason why the dance floor is empty is because most in the 10th parliament have correctly read the mood of the people and have opted for silence because they haven’t the slightest clue what they are supposed to do.
Kenya has changed forever and mark my words, the leading faces in the next general elections will barely be recognizable.
It really is very simple and my apologies for repeating this illustration in dozens of posts in this blog but I am afraid I can hardly find a better analogy to illustrate exactly what is going on here.
Think of the dog in the village that is so cowardly that when you cough it jumps. Then after years of abuse one day some not-so-clever guy corners it in some wall where it has nowhere to run. Suddenly the poor dog sees red and all the years of abuse and stones that have pelted it from every little boy in the village who has learnt to throw stones flashes across its’ mind. Suddenly that dog becomes very dangerous and the man who has cornered it cannot believe his eyes and is torn to pieces.
That cowardly dog that has reached its’ end is the Kenyan voter. Prepare to see the political class being torn into pieces, including all the big names some Kenyans like to worship.
So whoever wants to campaign for 2012 is very welcome to do so, at least some of them will be able to tell their grandchildren one day that they actually campaigned for the presidency in 2012. But I bet you that they will not want to discuss the number of votes they ended up getting.

IDPs Revisited: Kenya at War With Herself
» You Missed This That the absence of war does not necessarily mean peace has never been truer for Kenya. After staring apocalypse in the face following the bungled elections, all we have to our credit is making false impressions of motion without any trace of commensurate movements.
At our element best we settled for political expediency in superficial and cosmetic political theatrics cobbled as selfish power sharing while conveniently glossing over the fundamentals under agenda four.
Look around you and what do you see? The IDPs continue to transform themselves into permanent refugee status within their own country. Meanwhile the very leaders who are the cause and source of their Kenya horrid predicament have their eyes singularly trained on the next political trophy which is another 2000 days away. Unwittingly cheering these scoundrels on are the Kenyan Diaspora with the MOVE ON mantra as our kin and kiths continue to starve in IDP camps. But again, who cares venturing in stale non-industrious ventures anyway?
Not only have we exported our village stereotypes abroad but we even continue to give it an abstract sheen albeit packaged as objective road map. Meanwhile the tribal chiefs continue to milk dry our motherland auctioning any prized jewel within her borders.
The gimmick of power sharing is not worth the paper it is written on. A closer look will disabuse any pretence of break from fraudulent schemes to feather the ruling elite’s nests at our collective peril. The facade of Kenyan being at peace is surely the lull before the ultimate storm. In our penchant to bandage festering national wounds we prefer to gloat over smokescreens of progress in our shameless antic to continue digging while stuck in the deep hole. Soon and very soon, we have nobody but ourselves to blame when the balloon of deception is finally pierced by reality.
Peddling tribal hemlock
Just like Moi used to believe that a country prospered on mere strength of PEACE, LOVE and UNITY empty slogans, we continue to be led by people whose collective strengths are premised on vices. The GCG is nothing but a product of international pressure and no Kenyan politician can take any credit for it as evident in no efforts to own it towards it. We are back to old and dirty political games of scheming and nobody is taking lessons from the near-Armageddon to build sustainable structures for that contribute to national peace.
Almost 10 months down the road, the IDPs have been relegated to footnotes of our national conscience as the political plots thicken with alliances and pseudo alliances. Every corner of Kenya is teaming with non-reversing 2012 presidential convoys emitting fake miracles in their wake.
How I wish these scoundrels would devote half the energy and the same passion fighting our national basics of poverty and harmony. But that is a wish with wheels to ride on in Kenya. Instead the reality remains serial and shameless peddling of tribal hemlock. Surely, we must be condemned to the curse of living a collective national lie. -

Safaricon market dominance finally over as vicious tariff war begins
Last Week local GSM service provider ZAIN (former Celtel) launched a new tariff christened vuka, at the charge of 8/- per minute to any network. With that, Zain have at last effectively broken Safaricom’s long time strategy of locking in customers with high interconnect charges. They have also managed to woo a significant number of Safaricom loyalists to migrate to Zain. Last year Safaricom made a staggering Shs. 18billion in profits and it will be interesting to see how the latest development will affect the company’s bottom line.
Although Safaricom responded by introducing a new attractive off-peak rate, it still remains tricky for most because the off-peak rate applies past mid-night when most Kenyans have gone to bed. I do not know why the marketers at Safaricom want Kenyans to make calls at very un-Godly hours because the more the night wears on, the cheaper the Safaricom tariff becomes, but it goes back to kawaida tariff as soon as the day breaks! Even if Safaricon were to switch these rates to day time; the safaricon network is so bl**dy congested one cannot even check their balance!
Nonetheless, this week has seen many Kenyans effectively vuka from Safaricom to ZAIN, while the majority of business people have chosen to reserve their Safaricom lines strictly for receiving calls and texts. This has obviously resulted into a massive drop in airtime sales, although Safaricom are still receiving a significant part of their revenues through calls made from the lines of their competitors into Safaricom network.
It is being rumoured Safaricom are about to unleash a new lower tariff to counter ZAIN’s vuka tariff, but not far behind, Orange have also recently launched their GSM service with the cheapest in house call on one shilling to Orange numbers. Econet are also about to roll out their services. The target is an estimated 8 – 10 million new subscribers but the existing 14 million are also within sights for migration.
Another target for Zain is rumoured to Safaricom’s cash transfer and multi-million money minting machine; M-PESA. Zain and Postapay are already in advanced stages of negotiations for a partnership that will see postapay services available on Zain handsets. This will be a major challenge for Safaricom because as it so often happens, its micro-agents sometimes lack cash for paying out, which is a very frustrating experience for Kenyans in rural areas. Postapay on the other hand has existing and established infrastructure throughout Kenya’s post offices.
In the meantime, analysts have spent the whole week trying to figure out why Safaricom’s share price has stubbornly refused to rise beyond the Shs. 5/- IPO price and infact spiralled to an all time low of Shs. 4.05/- as of close of business last week. To add insult to injury, no one is in any particular rush to buy the low prices in anticipation of cashing-in when the price rises.
Although the Safaricom carries the baggage of shadowy shareholding like MOBITELEA and ALCAZAR CAPITAL, early predictions on the highly publicized IPO had indicated that the Shs. 5/- share price would stabilize at between Sh10 and Sh15. Other than the short period when the price traded at Shs. 8.15 in June, the predictions have not happened several months after the initial public share offer. Even worse, goal posts were moved midway when the share allocation rules were changed and those who did not get the shares they wanted are still waiting for millions of shillings in refunds.
The share price is largely static, averaging Shs. 5/-, and the latest downward spiral has raised very serious worries among investors and industry players. The worry is so much so that none other than the NSE’s Chairman has called for the suspension of the forthcoming Co-op bank IPO, which, just like the Safaricom IPO, is already attracting controversy and negative publicity following the acting Finance Minister’s move to protect the identity of some of the major shareholders! Blatant conflicts of interest and vested political interests are not helping the NSE either. Added to the disappointing performance of the share prices, all these factors are only but breeding more uncertainty and effectively discouraging investor participation at the Nairobi stock market.

Should Parliament Abolish Moi Day?

Today is Moi Day in Kenya. Under Chapter 110 of the laws of the country, October 10 of each year is recognised as a public holiday since the year 1989 when it was passed into law by parliament during KANU's rule.
However, since Moi’s retirement in 2002, the day has become a low key event without the traditional military marches, fly-overs and traditional choirs at all provincial and district headquarters.
Instead, most Kenyans stay away from school, work and their businesses or stay at home even as they wait for yet another public holiday on October 20 known as Kenyatta Day. Moi himself says Kenyans should reflect on this day by helping the less fortunate in society (sic). Walking through Nairobi Wests' Birongo Square today, the picture one gets looks more like a car wash / beer drinking day.
This month alone Kenya will have three public holidays given that Muslims celebrated they Idd Ul Fitr just last last week. Hindis also have their Diwali in October. The Hindi faith is a major employer in Kenya.
Whereas it is quite in order for humans to have adequate rest periods for purposes of health and safety and also to allow necessary participation in family, recreational, social and political activities, I have tried to figure out the relevance of these two public holidays and to be quite honest, I cannot see any benefit Kenyans get out of them.
Not only are the two October holidays a regrettable waste of resources and man-hours, they are also complete waste of time which is a tragic reality considering the gigantic task involved in turning this country around. I believe it is high time parliament relieved Kenyans of the huge burden arising out of these two holidays. If parliament sees it necessary that Kenyatta Day be retained because of historical significance, then I can only suggest that it be renamed Heroes Day or Wazalendo Day or whatever, but just not to name it to one individual who caused Kenya more harm than good in their life time.
On the other hand, the origins and current purpose of Moi Day does not provide any value addition to the Kenyan of today. Moi Day was made legal as a result of the egoistic nature of the then President who wanted to feel at par with his own predecessor (Kenyatta) who had a day (October 20) named after him. Moi even went as far as christening just about any public institution in his own name.
These are some of the favours that Hon Linturi and Hon Ababu should be extending to Kenyans in the 10th parliament au sio jamaa? -
Who Killed James Kamangu?

The news spread like wildfire around town and the country at large long before any news media had reported it. On many people’s minds were some unspoken questions which I will dare voice here.
Was Kamangu killed by the God of Bishop Hon. Margaret Wanjiru for trying to frustrate her and her work for God? Especially when the woman of God was looking for happiness in marriage?
Or was Kamangu’s death something to do with the fact that the good Bishop admits that she used to be a serious witch who made a certain woman who annoyed her go insane?
Mostly those who fear God will be asking the first question while those who do not will be asking the second.
Was Kamangu’s death an ordinary death for a man who was said to have loved his changaa a wee bit too much before fortune shone on his door and money poured in from still mysterious sources which changed his life even as he was thrust into national limelight? Or does his death have something to do with him getting mixed up with people whom the good book warns we should not point fingers to?
Suspicion was further raised by a clip shown on the TV news last night of the deceased man's angry brother storming his residence to try and find answers of why Kamangu had died so suddenly and under such mysterious circumstances.
His current wife (how was he going to get conjugal rights from the Bishop when he has another woman?) says that the man complained of abdominal pains and was rushed to a nearby clinic where he was promptly referred to Kenyatta National Hospital. She took him there and he was admitted and she went back home. Only to return the next morning to be told that her husband was no more. Sources close to the late Kamangu say that he suffered from ulcers for a long time. But stomach ulcers ordinarily do NOT kill people. And surely not as suddenly as the way in which Kamangu expired.
Well we also know that in many African cultures people do not die. They are killed. Even when they are over 100 years old and with every bone and organ in the body creaking for rest.
Whatever you think of this post, one thing is for sure. As the civilized, well educated Kumekucha readers read this post and laugh their heads off in sarcasm, ordinary folks in villages, small illicit brew dens and women cutting sukuma wiki next to smelly, overflowing drainage in some slum, are busy this minute discussing and speculating on one question; who killed James Ndimu Kamangu?
P.S. I have just remembered that the good Bishop spoke some deadly words about conducting the funeral of Kamangu when he was still alive. That will surely add fuel to the already burning fire. Ama?

Nigerians Honour Raila Odinga & Chinua Achebe

Prime Minister Raila Odinga and legendary Nigerian author Professor Chinua Achebe are today scheduled deliver lectures to commemorate the 25th anniversary of Nigeria's Guardian Newspaper Limited, publishers of the leading Guardian titles.
In the front page report on the lectures, the Guardian paper ran lengthy biographies on panafricanist, democrat and freedom fighter Odinga and, teacher, critic, poet and essayist Achebe, describing them as 'Africa's illustrious sons'.
The lectures will be held at the think-tank Nigerian Institute of International Affairs (NIIA) in the economic capital city of Lagos. Raila Odinga is to deliver a lecture entitled "Democracy and the challenge of good government in Africa".
Speaking to a battery of journalists who thronged the presidential wing of the Murtala Muhammed International Airport Lagos on Wednesday shortly after his arrival from representing Kenya at the 1st World Policy Congress in Evian – France, Raila said; "I want to basically thank my host for inviting me to Nigeria. I am very happy to be in Nigeria today. I have come with a team of fellow Kenyans. I like the spirit of Nigerians. You asked me about the electoral fraud. Electoral fraud can only be dealt with by reforms, through instituting total reforms of having independent electoral body to preside over elections. We have leaders of yesterday who are resisting change. They do not want to accept the will of the people through democratic process and those new ones who are coming in and are basically democrats like to play by the rule. This is a transition period from the time multi-partism came into Africa that is from the early 1990s up till now. ”
According to a press statement issued by Guardian Newspapers, Professor Chinua Achebe, best known for his evergreen classic, Things Fall Apart, will deliver a keynote speech at the event. Nigeria’s President Umaru Yar’adua will be the Special Guest of Honour while Nigeria’s former military head of state, Yakubu Gowon would serve as the Chairman of the Ceremony.

Here we are in the eye of a global storm with evidence pointing to Kenya’s integral involvement in gun running on behalf of Sudan and what do we do? Mutua and Wetangula have the ready script coloured in denial and with straight faces they shamelessly treat the whole world to the local folly which they serve Kenyans on daily basis.
Meanwhile Kibaki is busy mouthing directives for the same fraud-laden military to embrace technology. Speak of and imbecile immune to any sense of honesty. Sourcing the same technology is guaranteed to be another avenue to milk Kenyans dry. And that is Kenya’s brand of entrepreneurship at its best. Trust Kibaki’s apologists to shamelessly manufacture justification in defending the indefensible. Well, you cannot fault faithful disciples who readily point fingers while sheepishly defending the king of IMPUNITY who is truly leading by example and from the front.
You see Karume is no fool. The octogenarian may be out of parliament but he is smart enough to rope in willing Somalis if only to secure his share of the deal he painstakingly crafted but the present power brokers are naively scheming to disinherit him of. With the $8 million ransom agreed (from your taxes) Njenga is safe and sound. To his advantage, the industrious Karume knows the exact geography of Kibaki’s soft under belly like no other politician, alive or dead.
It wasn’t me
While creative bloggers cobble theories to baptize a zombie with waters of nostalgia, the eating chiefs are busy expanding the web as they auction every piece of Kenya. Who said you cannot scheme and profit over corpses? Somali has proved a haven of arms business as proved during the post-election violence. Only fools negotiate peace deals and leave empty handed. Definitely not Kenyans.
Kenyans are collectively suffering from the curse of tokenism and lowering the bar of expectation. Kibaki may have been everything good and progressive in his hey days but whitewashing grandiose failure with tales of economics learnt and taught in the first half of last decade is akin to dancing yourself lame to a stuck record. Its generosity notwithstanding, nature rarely rewards mediocrity. We are stuck with the skunk and its awful odour.
Trust is like virginity and betraying it is to rape yourself of any moral authority to justify acute cronyism that is definitely hurtling Kenya to the dogs. At the risk of inviting predictable barbs, I must point out that death is very unfair to people like Kamangu while conveniently avoiding bloody red scams bestriding our political shores. -
Why You Get That Sick Feeling Every Time You Think About Kenyan Politics
» You Missed This The signs are all there. Take a tour round Kenyan blogs to see what things political Kenyans are discussing. Most are busy discussing Barack Obama and the US presidential elections, many others including Kumekucha seem to have ran out of enthusiasm. Or even better ask around about viewership of prime time news in Kenya these days and you will be shocked. The whole situation is best illustrated by the kinds of headlines you see in leading Kenyan dailies these days. Surprise, surprise for the first time in its’ history the Daily Nation is carrying front page splashes on social topics that steer clear off politics.
To confirm what I am saying just talk to your friends about Kenyan politics and carefully observe their body language and what they say.
Actually I felt this thing myself only that I did not understand what it was until a friend told me that they were going through the exact same thing.
Kenyans are generally sick about Kenyan politics. And I mean really, really, sick.
Just how much emotional stress can a people take?
It started in 2002 and the euphoria Kenyans felt that year when the Kanu government was finally uprooted from power after 40 years on that memorable December 30th Day of 2002 at Uhuru park. Despite the high hopes we all after those elections, we ended up being terribly disappointed. I will never forget that man who was so elated that he swam in the murky waters of Uhuru Park and was captured by TV cameras. I wonder where he is now. And I also wonder what he would have said had he been told then that all the celebration was for nothing and that the worst was still to come. The worst came in 2007 of course. After the referendum drama and the long presidential campaign that started immediately after we ended up with nothing but the 2007 fiasco that some still insist on referring to as a general election which has left a bitter taste in the mouth of many Kenyans.
To add salt to a very raw wound the behaviour of Kenyan politicians is unbelievable. The heartless folks are already campaigning hard for the presidency in 2012. Yet the cement on the graves of victims of the post-election skirmishes is yet to dry properly. Let alone the fact that very frustrated and still grieving IDPs are roaming like refugees in the country that they call home. And the political class would care less. Of course they occasionally make the necessary “noises” for political advantage when the need arises.
Is it any wonder that most Kenyans these days feel like throwing up any time they hear Kenyan politics discussed anywhere?
If I was in the 10th parliament right now I would be very worried because I can assure you that in the next elections those Kenyans who make it to the ballot box will be very very very angry. Angry people are pretty unpredictable.

Kivuitu Headed For The Chopping Block?

So that is the last thing on my mind as I remind readers here about the warnings we gave to former Finance Minister Amos Kimunya that he would end up being used as a scape goat in the Grand Regency scum. Sadly Kimunya never saw it coming until it was too late and he was being undressed in parliament in a most humiliating way.
Now there is another man whose neck is rapidly headed for the chopping block and he does not seem to have the faintest idea. That man’s name is Samuel “I will not resign I did not beat up anybody” Kivuitu.
As you read this Kivuitu cannot travel to the United States courtesy of a travel ban slapped on 22 commissioners of the ECK. Although the travel ban has been imposed by a foreign power, at the very least this new development should have made the ECK chairman sit up and smell the coffee. Instead Kivuitu is busy discussing “retirement perks” and it would seem that he is even demanding more cash to leave office to make way for major reforms at the electoral body.
If truth be told, politics in Kenya has changed considerably since last December and the ill-fated general elections and the situation continues to be considerably fluid. Increasingly we are seeing public opinion and the will of masses winning the day. What happened to Kimunya should be a stark reminder of this. Kimunya’s case is particularly instructive because some extremely powerful forces were behind him and he made the mistake of thinking that this was enough “cushion” against anything. In fact Kimunya has been assured by these powerful forces that he will surely be re-appointed to the Finance docket in the next cabinet reshuffle by which time he will hopefully have been cleared from all wrong-doing. Ever wondered why for the first time in the history of the country we have an acting Finance minister (John Michuki) and yet the Finance minister is not sick or hospitalized?
Samuel Kivuitu seems to have sentiments that are quite similar to those that Kimunya had before he was quickly bundled out of office under intense public pressure. The difference is that Kivuitu’s ultimate fate could make Kimunya’s look like a walk in the park. There is an extremely high possibility that the chairman of the ECK might just end up behind bars.
There is no doubt that Kenyans are very upset. I dare say the vast majority of Kenyans are extremely angry about what the ECK did last December that cost the lives of so many innocent Kenyans, not to mention property of an untold value. But what has aggravated things is the insistence of people like Kivuitu and his fellow commissioners that they will NOT resign. This has just added insult to injury.
I am of course keenly aware that Kivuitu was taking instructions when he did what he did. Indeed Kenyans will remember that at one juncture he called a press conference where he fell just short of naming some very nasty Kenyans who “should not have been born” who seem to have put immense pressure on Kivuitu to announce some “prepared results.” A few days later that story together with a denial by the ECK chair that he did NOT sign a paid advertisement sent to the daily press detailing election results fizzled out. It was clear that somebody somewhere reigned Kivuitu back in line. Rumours have been flying that threats were made while others insist that cash was paid. Interestingly the Kriegler commission did not dare touch these bizarre chain of events that happened shortly after the election results were announced.
Now there is the business of the next general elections and there are high possibilities that certain powerful elements within PNU will want to distance themselves and their candidates from allegations of election theft. Now what better way to do this than to sacrifice a high-ranking official of the ECK?
The first time this information came to me, it sounded extremely far-fetched. But then I have remembered that there are a lot of other even more far-fetched things that have happened in politics over the last few months. One of them was of course the dramatic resignation of one Amos “I will NOT resign” Kimunya.
Of course Kivuitu and the commissioners would have been on much safer ground had they resigned much earlier this year, heading calls from most Kenyans and many bloggers here as well. But alas, that opportunity is now long gone. And there is real danger ahead for these guys.
Let us wait and see shall we?

The Standard Reveals Electoral Theft

The Standard on Sunday has today published a story that has confirmed massive irregularities, blackmail and theft that were behind Kivuitu’s astonishing declaration that Kibaki was the winner of the presidential polls.
Indeed, the story reveals a scheme that was mooted to deliberately prevent the ODM candidate Raila Odinga from ascending to the presidency through a fair, transparent and democratic means and it is not surprising no single observer group gave the election a clean bill of health.
The standard story further corroborates some truly tragic events captured in the Kriegler IREC report as well as those that were sensationally revealed by whistleblower Mr Kipkemoi arap Kirui who became a marked man as soon as he addressed an international press conference called by ODM leaders at KICC in which he said:
"I am speaking to the people of Kenya. My conscience would not allow me to see what I have seen and not speak about it. ECK is responsible for this mess. They (results) are altered here, not in the field. Form 16A is sufficient. I did it for the first time but could not proceed to the second constituency because of shameless, blatant, open alteration of documents presented by the returning officers. My conscience would not allow me to sit and keep quiet."
The publication comes against the backdrop of sustained pressure on ECK commissioners to resign and pave way for reforming Kenya’s electoral laws and institutions. It is emerging that a certain group within government does not want ECK commissioners to resign for fear that they will spill the beans with information that will be a threat to the viability of the grand coalition government and their own individual positions with it.
Interestingly, the riggers considered all bizarre possibilities including “allowing” Raila to win the presidency but lose the Langata parliamentary seat by force, and in process create a constitutional crisis that would allow the runners up (Kibaki) to continue ruling the country.
The report puts Kalonzo Musyoka – ODM-K presidential candidate and party leader – in an awkward position. Kalonzo was appointed Vice President in mid-January, just weeks after fighting a 'bruising bitter electoral contest' with Kibaki and Raila. It also shows Kalonzo’s agents actively participated in denying Kenyans the constitutional and democratic rights by putting undue pressure on Kivuitu while abetting what was clearly an electoral theft through fraudulent tallying.
What is the purpose of spending huge resources and have millions of citizens vote in general elections if the winner is already predetermined?

The Cut …even for Old Women

September 15, 2008 started off as a normal day for Consolata Kathambi. But it was never to end pleasantly. The claws of a nightmare were just lurking somewhere in the shadows.
This 35 year-old mother of three was at her home in Meru District (in Kenya) when she was informed of an impromptu visit from some female members of her village. She was shaken a bit for this was a strange visit. There had to be something the matter.
When she got to the door to let them in, she nearly fainted when she beheld the numbers. They were more than she had “bargained” for.
They cut to the chase and informed her that they had come to “transform” her to a “real” woman. Before she could digest the gist of that statement, they continued to say that she, Consolata, was not a real woman for she was not “circumcised”.
This hit her like a thunderbolt. She tried to piece this information together in her mind, but it did not add up. Her husband had accepted her as she was, so what were these women here to do? This whole thing just did not make sense.
Even then, female circumcision, in her community, is not for old women but for girls (up to a certain age group).
Things went so fast for her comprehension. Before she could shout Jack Robinson, she was being dragged across the compound. She could not see where they were taking her for she was blindfolded. Her shouting and kicking did not help matters.
Her hands and legs were held firmly. When they got to the “opportune” place, they stopped and tied her hands securely. Next, her legs were spread wide apart. They were not bluffing, they meant serious business.
She was circumcised by this mob of ‘fire and brimstone breathers’. She experienced something that she had all along hoped and believed that she had escaped. But then, tribal edicts had caught up with her and she was stripped to the last piece of clothing.
My Two Cents: Female circumcision is cruel to women and we should do everything in our power to do away with it. More and more people should join in this war (of terror!)

Was Kibaki Paid A Kickback By Southern Sudan?

In as much as the UN is the reigning international authority on world peace, I do not agree with its arms embargo on Southern Sudan. Having been murdered and enslaved by the Khartoum government, the black brothers of the south must defend themselves somehow. It is for this reason that I support Kibaki’s clandestine support for the South.
Dr. Alfred Mutua is telling us that the tanks were destined for Kenya. Our own DOD, US and other investigative agencies are telling us that the arms were enroute to Southern Sudan. Whom do you believe? ….that’s a rhetorical question.
That said, we have also been told that these shipments of tanks and guns have been going on prior to the elections…..meaning ODM was in the dark.
Given the ingrained culture of obtuse corruption in the pre-election Kibaki administration, is it plausible to suggest that the Southern Sudanese paid Kibaki some kickback cash to allow the transit of weapons?
Could this be the reason why Kibaki insisted on holding on to power no matter what? You see, subverting a UN arms embargo is a case for The Hague….. which could result in lengthy jail terms. Was he afraid that without the power of the presidency, he could be exposed as an arms dealer of some sought?
